Tiger poacher retracts consent for narco-test


BHOPAL: Hayrana s Dalbir Shrichand Bawaria a suspected middleman of an Indo-China tiger smuggling syndicate who was to undergo a narco test in connection with tiger poaching retracted his consent for the test minutes before he was to undergo the test in Gujarat. He gave a tough time to the state forest officials who took him to Gujarat for conducting the narco test after his consent. Babaria claimed the narco test would cause a long-term neurological impact on him. It took lot of efforts and counselling by the officials to make Babaria agree to take the test and the first round was held on Friday and will continue on Saturday according to officials. It took another few hours for the team to convince him to undergo the test previously applied on stamp paper scam kingpin Abdul Telgi (2004) Moninder Singh Pandher and Surendra Koli for Nithari killings (2007) 26/11 terrorist Ajmal Kasab (2008) Arushi s father Dr Rajesh Talwar mother Nupur in Arushi murder case (2008-2010) among others. Earlier another poaching suspect Mansingh underwent narco-analysis tests on July 30 2012 at the Forensic Science Laboratory (FSL) in Gujarat s Gandhinagar at the behest of MPSTF. He was taken to Gujarat only after he gave his consent but refused at the last minute prossibly after being brainwashed by some criminals in the jail that he would become mad after the test said an officer at the headquarters of the state forest department. Bawaria was earlier subjected to a lie detection test which he failed. His consent was necessary for the test following a 2010 ruling of the Supreme Court which said that the use of narco-analysis brain-mapping and polygraph tests on accused suspects and witnesses without their consent was unconstitutional and violation of the right to privacy. The bench made it clear that even when the subject had given consent to undergo any of these tests the test results by themselves could not be admitted as evidence because the subject does not exercise conscious control over the responses during the administration of the test. Only if any information or material is discovered subsequent to the tests then it can be admitted as evidence. This is the first attempt by Madhya Pradesh forest department in a wildlife poaching case. MPSTF (wildlife) wants to extract information about poaching of Madhya Pradesh tigers and their smuggling to foreign countries from him. He was taken to Gujarat after getting his consent. Officials have given a set of 30 questions to the forensic experts who conducted the test in the first round on Friday. Tests would continue on Saturday. Main focus is to crack the mystery surrounding the killing of T13 tigress of Pench and other tiger poachings in MP. The disappearance of T13 in February 2012 triggered outrage across the country. Its hide was confiscated by Nepal Police in Nuwakot district a year later along with four other tiger hides and seven sacks full of tiger bones. Bawaria was arrested in February this year after his name was revealed by another poacher named Chika who belongs to a traditional hunting tribe settled in Bihalari village of Katni district. Chika was arrested along with gang member Mamru on June 6 2013 when they fell for a tiger-hide sting by Nagpur s crime branch and MP forest officials near Mansar. During interrogation in Nagpur the alleged poachers confessed to trafficking 20 tiger hides from the Pench-Kanha corridor and Vidarbha region. Bawaria is currently lodged in Seoni jail. Bawaria was first arrested by WCCB on November 21 2013 from his native place Samlakha in Panipat district of Haryana. He is being probed by CBI in a tiger skins seizure at Nagpur railway station in 2009.
